Public Notice of the Docket Mirror White Paper: Introducing the concept of the Docket Mirror, defining a public-facing, legal document restoration proof of concept intended to rebalance justice. The intention is for Docket Mirror to restore the native text layer and full quality presentation of self-represented filings so they can compete on a more equal footing with those of counsel-represented parties. Docket Mirror will connect the URL of each restored filing to that to its twin on the public docket, with reports demonstrating they are mirror images but for retained quality and text-crawlability. Each filing pdf on Docket Mirror utilizes its web page wrapper to host AI-training schema in order to teach search engines and AI to trust its more easily crawled and higher quality versions of public documents that have been degraded by scanning. South Carolina’s state court system, like that of 27 other states, prohibits self-represented litigants from submitting their filings digitally, creating a 2-tiered justice system. Parties represented by counsel benefit from full quality images, native text, and freedom from being hidden from immediate impressions by cover sheets for motions that have grown to 4 pages per motion in this court over the course of this case. Pro se motions, conversely, are hidden under the cover sheets. And essentially all of their filings are degraded by being scanned in at various degrees of quality, most frequently - per our study of pro se filings in this case - at a 1-bit bitonal setting that has its roots in bandwidth-constricted fax machines from the 1980s. [Exhibit A: Record Fidelity Filings Audit Summary] The need was recently demonstrated when an AI-generated summary stated that this case ended with the August 3 Order and that Plaintiffs would not pursue further review. That was incorrect. Upon examining the AI’s sources, it was discovered that the public docket, as a primary source government site, was trusted as a high authority information source. And the AI did not ingest the self-represented Plaintiff’s counterpoints on the docket at the same rate because Plaintiffs’ text-based arguments had been flattened into images, and web crawlers prefer easily crawled native text to OCR.
A Positive Access-to-Justice Tool, p. 3 (p. 3-3)
A Positive Access-to-Justice Tool. Docket Mirror is thus offered as a constructive bridge to equal access to justice, and is not intended to replace the official docket or request that the Court endorse any disputed claim. It is being developed to test the visibility-increasing technology of STL Schema as a method to enhance access to justice for the vulnerable in one of only two states where the Legislature selects the state level judges. South Carolina has 2.06 attorneys per 1,000 residents, about half the national average, and is 50 th out of 50 states in lawyer density per population. Unlike Virginia, the other state where the legislature selects judges, South Carolina has a commission (the Judicial Merit Selection Commission or JMIC) which pre-selects the judges the legislature can vote on. The JMIC is composed largely of attorney-legislators who could try cases in front of the judges they help select.
